Regulation no. 12 of 2005
Concerning repartition of work in the Public
Prosecution
After perusal of regulation no. 16 of 2002
concerning redistribution of work in the public
prosecution and regulation no. 36 of 2004
concerning the reorganization of the prosecution
at the Court of First Instance and the
subsequent notices;
It was decided the following
Reorganization of the Public Prosecution and
repartition of its members in the following
manner:
First : The technical Office of the Head
of the Public Prosecution:
Mr. Khalifeh Rashed Ben Dimas, the public
Attorney, is appointed the Chief officer of the
technical office of the Head of the Public
Prosecution and shall be in charge of the
technical and administrative supervision thereof
and execute all the duties assigned to him by
the Prosecutor General, assisted by Mr. Ismaïl
Malih, Chief prosecutor, and by Counsellor Bakri
Abdullah El Sayed, Counsellor at the technical
office of the Head of the Public Prosecution.
Second: The Prosecution at the Court of
Cassation:
Mr.
Ali Hassan El Marzouki, Chief prosecutor, is
appointed the Chief prosecutor at the Court of
Cassation and shall be in charge of the
technical and administrative supervision of the
office, assisted by Mr.Abdul Rahman Mohammed
Rashed El Oumari, assistant chief prosecutor.
Third: The Prosecution at the Court of
Appeal:
Mr. Hamad Joum’a El Khalafi, Chief prosecutor,
is appointed Chief prosecutor at the Court of
Appeal and shall be in charge of the technical
and administrative supervision of the office,
assisted by Mr.Walid Mohammed El Binay,
assistant chief prosecutor.
Fourth: The Prosecution at the Court of
First Instance:
Five: The Civil Prosecution:
Mr. Abdullah Mohammed Kleib, first chief
prosecutor, is appointed Chief of the civil
prosecution and shall be in charge of the
technical and administrative supervision
thereof, assisted by Mr. Issa Mohammed Sabt,
Deputy First Prosecutor, Mr. Ayoub Ali Hatem,
Deputy Prosecutor and Mr.Youssef Mohammed
Abdullah Hajouni, Deputy Prosecutor.
Eight: Each Chief Prosecutor shall be in
charge of the following:

Repartition of the work in his prosecution
office in the most efficient way.

Supervising the police stations in all
matters concerning the criminal aspect of
the investigations and inspection of the
detention places, examination of the
detained persons complaints as well as
requests of opinion and requests for
inspection authorizations, answering the
queries of the field officers and all other
matters related to the work. He may refer
for discharge part of this work to any
members of the prosecution except the
requests for opinion which must be
sanctioned by the approval of the Chief
prosecutor or his assistant.

Examining the grievances of the parties to
the litigations and their attorneys during
the investigation stage with the members of
the prosecution.

Providing the technical office of the Head
of the Public Prosecution with a copy of the
reports on inspection of detention places.
Nine: Mr. Ali Hmeid Ben Khatem, assistant
Chief prosecutor, is delegated to work in the
technical office of the Head of Public
Prosecution in addition to his original duties.
Ten: It shall come into effect as of
Saturday 21/5/2005
