Dubai Public Prosecution closed the “rapped British lady “ from Pakistan Origin, which was raped by an indian waiter in the hotel, this issue is already has been reported in different British media without clear understating of the incident nature and what actions has been taken by Dubai police.
The Chancellor Essam Isa Al-Humaidan, Attorney General at the Dubai Public Prosecution said :” Dubai Public Prosecution has ended the investigation and disposition of the case, the indictment against the indian waiter to rape the British girl because of the invalidity of this case. As well the indictment against the girl and her boyfriend, because of the marriage contract date which was prior to the incident date, where the indictment about alcohol drinking without a permit will be referred to the ruling court.”
He added: “ some of the media was issued the story without any real facts such as ignoring the rapped girl case or the offender is from Arabic nationality, or the police is forcing them to get married, in spite of posting unreal facts, Dubai public Prosecution has been taken decisions in this case as per the criminal procedures law in the UAE, which is applied to everyone, without distinction of religions, gender, or nationality. The real picture of the story that a British lady reported to police on 1st January 2010 that she came to UAE to meet her British friend claiming the existence of a matrimonial bond between them.”
They both stayed in the hotel, having sex several times, and the night before she has been raped under of alcohol influence, and accused the indian waiter who assisted her to go the
Bath room, the girl did not reported any marriage relationship. Upon receiving the report, Dubai Police has taken the legal procedures as per the british girl's story.
The investigation and criminal team went to the hotel, they have arrested the waiter, the Victim and the offender has been transferred to the forensic testing, during the
investigation, the offender has denied the incident and the victim decided the fact that both were so drunk and unconscious, therefore they are not remembering at all what's happened, and she wish to cancel the report, while her british friend agreed on that.
In addition there was no rape effect or physical injury. At the beginning of the investigation, the both couples were unable to prove their marriage relationship, and drinking alcohol without proper permission, they have been given sufficient time to prove their marriage relationship.
The Forensic Medical test proved the false incident at 31 december 2009, the Both couples provide a legal marriage certificate date 17 november 2009 which is the date before the incident. Dubai Public Prosecution decided to close the case as per the investigation procedures.
It is also proved the both couple is having sexual relationship based on the matrimonial relationship, they were referred to trial because of Alcohol drinking as per the law of the country to protect the community.
